Objectives

On March 11, 2021, President Joe Biden signed the American Rescue Plan Act of 2021 ("ARPA") into law. ARPA is a $1.9 trillion economic relief package intended to address the COVID-19 pandemic. ARPA allows for the first $10,200 of unemployment benefits to be untaxable for households with an adjusted gross income of up to $150,000. As expected, states have chosen a variety of reactions to this new legislation.

CANN/AThe California Franchise Tax Board is revising the 2020 Schedule CA (540 & 540NR) instructions to incorporate the necessary adjustment for the federal unemployment compensation exclusion ("UCE"). The following instructions will be added to Schedule CA (540), Part I, Section B, line 8 and Sch CA (540NR), Part II, Section B, line 8 as follows: "If you excluded unemployment compensation ("UC") on federal Schedule 1 (Form 1040), line 8, enter that amount as a positive number of line 8f, column C, and write "UCE" on line 8f" Note: For California purposes, the full amount of UC is already excluded above on line 7, column B. The adjustment on Schedule CA, line 8f, column C (Additions) is needed to avoid double exclusion of UC from California income.

(3) Virginia returns should utilize the VA Fixed Date Conformity addition for the amount of UCE for federal purposes and then allow taxpayers to claim the 
VA subtraction (Code 37) for the full amount of the UC (which would be equal to or greater than the amount excluded for federal purposes, depending on the amount of unemployment received by the individual). This ensure the "math" is transparent on the return. 
(4) If the return has already been filed, do not amend. If the return has not been filed, then add the federal UCE amount to Wisconsin Schedule I, lines 2h, 2i, or 2j. Determine eligibility for Wisconsin subtraction by completing Wisconsin Schedule SB.
